This is a documentary that aired on CBC Radio's "The Current"
Weighing the Balance evolved from a simple question: what happened to the men who were named and shamed in a very public news conference staged by the Toronto Police. Six men, their ages and places of residence were named as people who had purchased child pornography. Upon investigation, Kellie Hudson found that one man wasnt even charged, and while three had gone to court, two had had their charges quietly withdrawn. One of those men was James Lecraw. Despite the withdrawal of charges, LeCraw lost his job, friends and eventually, in deep despair, took his own life. This is James story, as told by his brother and
niece, his former employer and through his own words.

ADDITIONAL LICENSE TERMS
ROYALTIES: Licensee represents and warrants that it shall be responsible for the public performance royalties and mechanical rights royalties that are payable to associations and/or collectives for Licensees use of the Program, including for music reproduction and communication to the public by telecommunication. CBC will provide music use reports.
EDITING: The Program and all other materials delivered by CBC shall be used in their entirety. It is a condition of this Agreement that the Program may not be edited, modified, or altered in any way whatsoever. Notwithstanding the foregoing, CBC authorizes Licensee to edit the Program as it deems necessary to meet reasonable scheduling and timing requirements, on the condition that Licensee maintains the editorial integrity of the Program. It is a further condition of this Agreement, that Licensee shall not remove or alter any production credits, titles or copyright notices contained in the Program.
COPYRIGHT: Licensee shall include an oral copyright credit in broadcasts of the program, attributing CBCs copyright ownership and, if provided, production credits.
CONFIRMATION: Licensee agrees to provide to CBC a confirmation of broadcast of the Program within ten (10) days of each broadcast.
WARRANTIES AND REPRESENTATIONS: CBC represents and warrants that:
(i) it has the full right and power to conclude and execute this Agreement and there is no agreement with any other person, firm or corporation which could in any way interfere with any of the rights granted to Licensee under this Agreement; and
(ii) it is the sole owner or has obtained or will have obtained prior to delivery of the Program all consents and rights necessary to grant Licensee the rights granted herein, with the exception that CBC does not represent or warrant that Licensee may exercise performing rights or reproduction rights in the music without the payment of performing rights and mechanical rights royalties or license fees for such music.
Licensee represents and warrants that:
(i) it has full right and power to enter into and completely perform this Agreement and there is no agreement with any other person, firm or corporation which could in any way interfere with its performance of any of its obligations under this Agreement; and
(ii) it will only transmit the Program in accordance with the terms and conditions of this Agreement and that it shall not distribute, exploit or use the Program in any way following the expiry or termination of this Agreement.
INDEMNITIES: Licensee hereby indemnifies and holds CBC harmless from and against any and all loss, damages, and expenses, including reasonable legal fees and disbursements, which CBC may incur as a result of any claim, action or proceeding arising from the breach of any of the provisions of this Agreement by Licensee.
CBC hereby indemnifies Licensee and holds it harmless from and against any and all loss, damages, and expenses, including reasonable legal fees and disbursements, which Licensee may incur as a result of any claim, action or proceeding arising from the breach of any of the provisions of this Agreement by CBC.
Both Licensee and CBC shall promptly notify the other of any pending, possible or actual claim to which these indemnities may apply.
All representations, warranties and indemnities made and/or given herein shall survive the termination of this Agreement.
DEFAULT: Either party shall be deemed to be in default of this Agreement if it breaches or fails to perform any material obligation, representation, warranty or covenant under this Agreement, or any other agreement between the parties hereto, and fails to cure same within fifteen (15) days of receipt of notice of such default by the non-defaulting party.
In the event of any default, the non-defaulting party shall have the right, in addition to all other remedies it may have in law or equity, to terminate this Agreement in its entirety by giving notice to the defaulting party and to be relieved of all liabilities and obligations hereunder.

GOVERNING LAW & JURISDICTION: This Agreement will be governed, performed and enforced in accordance with the laws of the Province of Ontario and the federal laws of Canada. The Parties agree to attorn to the exclusive jurisdiction of the Courts of Ontario.
